Fixed fee Divorce

We offer a fixed fee divorce service for the more straightforward cases giving you peace of mind with regards to the costs.
 
The Cost
  • All steps from initial instructions to the Decree Absolute in divorce cases and the Decree in judicial separations;
  • The fees are £895 +VAT;
  • This excludes the court fees for filing the petition (£345) and obtaining the Decree Absolute (£45);
  • This is for an uncontested divorce;
  • Unlike “on-line” divorces you will receive personal service from one of our solicitors with the opportunity to come in and discuss matters. We will guide you through the process step by step;
  • You speak to the solicitor dealing with your case not a call centre.
What work is covered?
  • This plan covers the preparation and issue of the Divorce Petition and all the steps that need to be taken to obtain Decree Absolute, including:
o       Drafting and preparing the Petition,
o       The Statement of Arrangements for Children if required,
o       The Certificate of Reconciliation
 
  • Arranging for documentation to be issued at Court;
  • After your husband/wife is served, notifying you and then dealing with the drafting of the Special Procedure Affidavit;
  • Applying for Decree Nisi;
  • Applying for Decree Absolute;
  • Legal advice on impact of divorce.
Should the matter become more complex, for example your spouse defends the proceedings or files a Cross Petition (seeking a cross divorce against you), we reserve the right to increase the costs according to the extra work incurred. Should this happen, we will notify you immediately, before any additional costs are involved and give you an estimate of the likely increase in the fees, and outline the additional work. If the Petition is defended, the procedure becomes more complex and cannot be carried out on a fixed fee basis and a tailored estimate of further costs will be given.
 
If your spouse fails to return the acknowledgement of service once papers have been posed to them by the court, extra fees would be incurred in organizing bailiff service or instructing an enquiry agent or making an application for deemed service.  On issuing the Papers, the Court posts the Petition to your spouse or their solicitors. If your spouse fails to deal with the papers it may become necessary to have a further set of the papers delivered by hand by an Enquiry Agent so that the divorce can progress. If this is necessary, our fees will increase by the cost of the Enquiry Agent's fees.
 
What work is not covered?
  • Any work that is necessary if the Petition becomes defended, or needs to be altered (amended) once it has been issued by the Court;
  • Enquiry Agents/bailiff fees if the papers have to be served personally on your spouse;
  • An application for deemed service;
  • The cost of swearing the affidavit in support of the Petition (c£5.00-£9.00);
  • The fee for obtaining a copy marriage certificate (£9.00);
  • Any submissions to the court or the other side in respect of claiming fees for the divorce;
  • Extended negotiations with your spouse regard the allegation ‘unreasonable behaviour’;
  • Extended negotiations with the respondent with regard costs;
  • Any advice and proceedings concerning property, finances and children.
