Crellins Carter approaches both preparation of Wills and administration of estates with sensitivity and professionalism combining expertise and efficiency with a considerate, personal service. Your personal and financial achievements are important both to you and to us. We can help you protect and make the most of everything you have worked hard for, so it’s there for you and your family to enjoy now and in the future.
Wills
We use our specialist knowledge to help you make a Will that is clear and tax efficient. We prepare all types of Wills, simple to complex. Our clients range from young to old. It is important to review your Will regularly to take account of changes in personal and financial circumstances and changes in the law.
Lasting Powers of Attorney (LPA)
It is important to make plans now for old age or retirement when you may not be able to manage your affairs due to mental or physical impairment. A Lasting Power of Attorney is a document which enables a trusted person (usually a relative) to look after your financial affairs or your personal welfare. You are able to choose now the person who you prefer to make decisions on your behalf if you are not able to do so. You may not need an LPA now, but if you do need it later, you may by then not be well enough to create one. Because you sign an LPA now does not mean that it has to be used now or ever. We can help you by discussing your requirements and drafting the necessary LPA document.
Probate
When a loved one dies it can be an upsetting and distressing time. Consequently dealing with the paperwork and technicalities involved in administering their estate may be the last thing you want to do. We offer you sympathetic, hands on support which we believe you will find invaluable at this most difficult time. There are many ways we can help, including:
- Assisting with registration of the death
- Applying for Probate
- Preparing documents for the Probate office and the Inland Revenue.
- Completing the administration of the estate
- Advising on the meaning of the terms of the Will
- Explaining intestacy rules if there is no Will
- Explaining the tax issues connected to the estate
- Helping with the sale of any property
- Dealing with disputed Wills and claims against estates
Disputes
We can also advise on disputes surrounding a will or intestacy. This type of dispute or litigation can often be protracted and expensive. Our detailed knowledge of the basis of claims and court proceedure can lead to an early, negotiated conclusion, saving both cost and stress.
Inheritance Claims
Sometimes a deceased person does not provide appropriately for persons who should receive ongoing maintenance or support from his estate. We are experienced in advising on the complex rules which regulate these claims and in bringing and defending (as necessary) claims against estates of deceased persons.
